How to leave a gift in your Will

A gift in your Will, no matter how big or small, can make a real difference to your community long into the future. There is a long tradition in North Devon of legacies improving care in local hospitals.

There are several different types of legacies and choosing how to make your gift is an important decision. If you already have a Will, you can amend it with a Codicil. We always recommend speaking to your solicitor to talk through your options but there is a rough guide below.

Leave a share of your assets (a residuary gift)

People can gift a percentage of what is left of their assets – known as their ‘estate’ after they ensure that their family and loved ones have been taken care of.

This type of gift is known as a residuary gift and is easy to add to an existing Will without interfering with any specific sums you may have left to family or friends.

Wording to use to leave a residuary gift:

I leave my / X share(s) of my residuary estate for Over and Above, Royal Devon University Healthcare NHS Foundation Trust, Raleigh Park, Barnstaple, Devon, EX31 4JB, Registered Charity No. 1061384, to be used absolutely for its general charitable purposes and I declare that the receipt of the treasurer or other proper officer for the time being shall be a sufficient discharge to my executors.

Leave a fixed sum of money (a pecuniary gift)

You may wish to leave us a stated sum of money. This kind of gift is known as a pecuniary gift.

Wording to use to leave a pecuniary gift:

I give free of tax £X to Over and Above, Royal Devon University Healthcare NHS Foundation Trust, Raleigh Park, Barnstaple, Devon, EX31 4JB, Registered Charity No. 1061384 for its general charitable purposes and I declare that the receipt of the treasurer or other proper officer for the time being shall be a sufficient discharge to my executors.

Leave a specific item of value (a specific bequest)

You may wish to leave us a particular item, which can be sold to support our hospitals. It could be property or an item of value such as an antique or a piece of jewellery. If you are considering leaving us a specific item, please call us on 01271 311 772 to discuss this further.


Once you have made the decision to leave a gift in your Will to Over and Above, you may like to think about what impact you would like that gift to have. There have been occasions in the past when we have not been able to accept bequests as the wording has been too restrictive. It is also, of course, impossible to predict every medical advance or new development. We therefore ask that you consider leaving a gift to our General Purposes Fund as this will ensure that our charity trustees can direct funds where we need them most at that moment in time.
